featureIsraeli law enforcement and all other relevant ministries are criticizing the ruling by the high court of justice that it is illegal to jail illegal immigrants, which have flooded Israel in the last few years.

“The law will have to be changed in order to be able to deal with the problem. The court did not grasp the severity of the problem” one source said.

All of the thousands of migrants held in the Saharonim detention center must be released and their status ruled on within 90 days according to the High Court of Justice, which struck down by a 9-0 vote the state’s entire new policy regarding African migrants on Monday.

The surprising ruling leaves significant uncertainty as to how the state will comply both with the court’s order and with its stated objectives to use all legal means to minimize and “voluntarily” deport thousands of migrants in the face of a public which is generally weary of the large increase in migrant numbers in recent years.

The need to decide whether the migrants are official refugees under international law creates the possibility that the state may have to offer permanent residence to the migrants within the 90 days, though there are many other possibilities as well.

The sources that talked with i-HLS said that the ruling does not realize the problem and its implications. “The government will have to make a swift change in law to bypass this ruling”, in order to avoid very serious potential problems.
